Thailand SEC Greenlights Local Crypto ETFs: New Regulatory Framework Set for 2026
By Lauren Towner · 12 October 2026

The Securities and Exchange Commission (SEC) of Thailand has formalised a regulatory framework for crypto exchange-traded funds (ETFs), enabling asset management companies to launch products tracking digital assets. This move integrates institutional-grade crypto investment into the Thai capital market, providing a regulated structure for professional and retail exposure while enforcing strict custodial and leverage constraints.
What was announced
The Securities and Exchange Commission issued 11 notifications establishing the operational rules for crypto ETFs, which are scheduled to take effect on 16 October 2026. These regulations allow Asset Management Companies (AMCs) to establish and manage crypto ETFs as passive investment vehicles designed to track the price of specific digital assets. To ensure focus and transparency, these funds must maintain an average net exposure to a single crypto asset of at least 80 percent of their net asset value (NAV) over each accounting year.
Initially, the SEC has restricted eligible underlying assets to Bitcoin and Ethereum, citing their liquidity, market acceptance, and network security. All crypto ETFs must be listed and traded exclusively on the Stock Exchange of Thailand (SET). Furthermore, the SEC has mandated that these funds be safeguarded only by digital asset custodians regulated by the commission. Asset management companies seeking to establish these funds must demonstrate adequate organisational readiness, including specific personnel and operational systems.
The framework also addresses market stability by prohibiting securities companies from providing margin loans for the purchase of crypto ETFs, mirroring existing rules for direct digital asset trading where lending for crypto purchases is not permitted. In a significant shift for institutional investors, the SEC has amended regulations to allow domestic mutual funds and private funds to invest in these Thai-listed crypto ETFs. Previously, these institutional vehicles were only permitted to invest in foreign-domiciled crypto ETFs, subject to existing investment limits.
"The proposed regulations aim to broaden investment opportunities for investors, enhance the capabilities of business operators, and promote the crypto ETF ecosystem under an appropriate investor protection framework."
The Securities and Exchange Commission
The companies involved
The Securities and Exchange Commission serves as the primary regulator for Thailand’s capital markets, overseeing the issuance of securities and the conduct of digital asset business operators. Its role has expanded significantly as Thailand seeks to balance financial innovation with rigorous investor protection, particularly in the volatile digital asset sector. The commission is responsible for setting the standards for digital asset investment management and the eligibility of custodians who act as mutual fund supervisors.
The Stock Exchange of Thailand (SET) is the national stock exchange and will serve as the exclusive trading venue for the newly regulated crypto ETFs. As a central pillar of the country's financial infrastructure, the SET has been active in modernising its operations to accommodate digital-first financial products. It operates under a regulatory framework that emphasises transparency and market integrity. The exchange has recently focused on technological integration, seeking to enhance its capital market ecosystem through international partnerships and the adoption of advanced data management systems. By hosting these crypto ETFs, the SET positions itself as a critical bridge between traditional equity markets and the digital asset economy, providing the necessary liquidity and oversight for institutional-grade crypto products.

What this means
The SEC’s decision to allow domestic crypto ETFs signals a transition from cautious observation to active integration of digital assets within the traditional financial system. By limiting the initial scope to Bitcoin and Ethereum and banning margin lending, regulators are clearly prioritising market stability over rapid expansion. This puts pressure on local asset managers to prove their operational readiness and custodial security well before the 2026 deadline. The move also challenges regional financial hubs that have been slower to provide a clear path for institutional crypto products. The central question for the industry remains whether the two-year lead time will allow Thai operators to build a competitive ecosystem or if the global market will have significantly evolved by the time these funds go live.
